Welcome to MailboxHero.com ("MailboxHero", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the MailboxHero platform, services, and website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Overview of Services
MailboxHero is a software platform that enables mail centers to manage digital mail images, mailbox rentals, customer communications, and related business operations. The platform also allows mailbox renters (“Customers”) to securely access scanned mail and account information.
2. Eligibility and Accounts
To use the Service, you must be at least 18 years old and capable of entering into a legally binding contract. Mail centers must register for a mail center account to access administrative tools. Customers may access mail through accounts created by their mail center. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.
3. Acceptable Use
You agree to use the Service only for lawful purposes. You will not:
- Upload, transmit, or store content that violates any law or infringes upon others’ rights;
- Use the Service for spam, scams, or fraudulent purposes;
- Attempt to gain unauthorized access to other accounts or MailboxHero systems;
- Interfere with the operation, integrity, or security of the platform.
4. Fees and Payments
Mail centers may subscribe to paid plans processed securely through Stripe. Fees, renewal schedules, and plan limits (including maximum mailboxes or envelopes) are displayed within the AccountCenter. All payments are non-refundable unless required by law. Customers may also make payments to their mail center through MailboxHero where applicable; MailboxHero acts solely as a technology provider and not as the billing party.
5. Ownership and Intellectual Property
MailboxHero retains all rights, title, and interest in and to the Service, including software, design, logos, trademarks, and other intellectual property. mail centers retain ownership of their customer data and uploaded images. By using the Service, you grant MailboxHero a limited, non-exclusive license to process and display content solely for operating the Service.
6. Data Handling and Privacy
MailboxHero processes information in accordance with our Privacy Policy. We use commercially reasonable safeguards to protect stored data. mail centers are responsible for ensuring compliance with applicable privacy and postal regulations (e.g., USPS Form 1583 retention and ID verification rules).
7. Email and Notifications
Transactional and verification emails are sent via Brevo or equivalent email service. By using the Service, you consent to receive necessary communications such as account verification, password resets, and billing notifications.
8. Service Availability
We strive for high uptime and reliability but do not guarantee uninterrupted access. Scheduled maintenance, upgrades, or outages may occur. MailboxHero is not responsible for delays or failures caused by internet connectivity, hosting issues, or third-party services.
9. Termination
We may suspend or terminate access to the Service at any time for violation of these Terms or misuse of the platform. Upon termination, mail centers may request export of mailbox data within 30 days. Customer data may be deleted in accordance with retention policies.
10. Limitation of Liability
To the fullest extent permitted by law, MailboxHero and its affiliates, officers, and employees shall not be liable for any indirect, incidental, or consequential damages arising from your use or inability to use the Service. Our total liability shall not exceed the amount paid to us in the preceding three months.
11. Indemnification
You agree to defend, indemnify, and hold harmless MailboxHero from any claim, loss, or expense arising from your use of the Service or violation of these Terms.
12. Changes to These Terms
We may update these Terms periodically. The “Effective Date” at the top reflects the most recent version. Continued use after changes constitute acceptance of the updated Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.
